I have been surprised that an estoppel issue hasn't been raised by Google. Android is based in part on Apache Harmony. I know for a fact that Sun was fully aware of Harmony and while not allowing Apache the toolkit needed to test for "Java compatibility" did *nothing* to stop its development. In my opinion that would go far beyond a fair use issue.
