We're still digesting today's lengthy decision in the Oracle v. Google appeal, but we're disappointed-and worried. The heart of the appeal was whether Oracle can claim a copyright on Java APIs and, if so, whether Google infringed that copyright. According to the Federal Circuit today, the answer to both questions was a qualified yes-with the qualification being that Google may have a fair use defense.

I too am going to take some time to digest this and come back with some commentary. Before I do, there is a little something I want to state. I have been surprised that an estoppel issue hasn't been raised by Google. Android is based in part on Apache Harmony. I know for a fact that Sun was fully aware of Harmony and while not allowing Apache the toolkit needed to test for "Java compatibility" did *nothing* to stop its development. In my opinion that would go far beyond a fair use issue.
